If you sell clothing in Europe — or plan to — 2026 is a turning point. Two major regulations are now in effect that will change how you source, manufacture, and manage inventory.
Here’s what every apparel brand owner needs to know.
1. No more destroying unsold stock
Under the EU’s Ecodesign for Sustainable Products Regulation (ESPR), large companies can no longer incinerate or landfill unsold apparel, accessories, or footwear. Unsold inventory must be reused, recycled, or donated.
Why it matters: Overproduction now carries real financial risk. Brands that previously relied on “sell or destroy” models will need to shift toward smaller, more accurate production runs and faster replenishment cycles.
2. Extended Producer Responsibility (EPR) fees are coming
Producers — including brands, importers, and manufacturers — must pay for the collection, sorting, and recycling of textile products they place on the EU market.
The fee is determined by eco-modulation: better environmental performance (higher recycled content, greater durability, no hazardous substances) means lower fees. Poor design leads to higher costs.
Why it matters: Sourcing from a factory that can document recycled fiber content and avoid restricted substances will directly reduce your EPR liability.
3. Digital Product Passports (DPP) are on the horizon
Soon, every garment sold in the EU will need a Digital Product Passport — accessible via QR code — listing recycled content percentage, repairability score, care instructions, and end-of-life handling.
Why it matters: Your manufacturer must be able to provide verifiable, batch-level data. Factories with OEKO-TEX, GOTS, and recycled content certifications are already prepared.
What this means for your sourcing decisions
Certifications are no longer optional. OEKO-TEX, GOTS, BSCI, and FSC directly lower your compliance costs and reduce legal risk.
Traceability matters. Choose manufacturers who can document material sources and production batches.
Plan for smaller, more accurate orders. Avoid overproduction penalties by improving demand forecasting and using low-MOX manufacturing partners.
